The University of El Oued is dedicated to upholding the rights and welfare of all individuals contributing to its mission, including those employed through third-party service providers. This policy ensures that workers engaged via outsourcing arrangements receive rights and benefits equivalent to those of direct employees, in compliance with Algerian labour laws and international labour standards.

Purpose

This policy aims to:

  • Guarantee that outsourced workers enjoy equitable rights and protections comparable to direct employees.
  • Ensure adherence to national labour regulations and international conventions concerning fair labour practices.
  • Promote ethical employment standards across all university operations and partnerships.

Scope

This policy applies to:

  • All departments and units within the University of El Oued that engage third-party service providers.
  • All third-party organizations and contractors supplying labour or services to the university.

Policy Guidelines

  1. Compliance with National Labor Laws
  • Adherence to Algerian Labor Code: The university ensures that all outsourcing contracts comply with the provisions of the Algerian Labor Code, particularly those related to employee rights, working conditions, and non-discrimination.
  • Observance of Minimum Wage Standards: All outsourced workers must receive wages that meet or exceed the national minimum wage, as stipulated by Algerian law.
  • Working Hours and Overtime: The university guarantees that outsourced workers’ working hours and overtime compensation align with national regulations, ensuring fair treatment and adequate rest periods.
  1. Alignment with International Labor Standards
  • ILO Conventions Compliance: The university upholds the principles of the International Labour Organization (ILO) conventions, including the Forced Labour Convention (C29), ensuring that all labour practices are free from coercion and exploitation.
  • Prohibition of Forced and Child Labor: The university strictly prohibits any form of forced labour, slavery, human trafficking, and child labour within its operations and requires the same commitment from all third-party service providers.

  • Equitable Employment Terms: Outsourced workers are entitled to employment terms, including wages, benefits, and working conditions, equivalent to those of direct employees performing similar tasks.
  • Non-Discrimination: The university enforces a strict non-discrimination policy, ensuring that all workers, regardless of employment status, are treated fairly and without bias based on race, gender, religion, or other protected characteristics.

  • Safe Working Environment: The university ensures that outsourced workers operate in environments that meet health and safety standards, providing necessary training and protective equipment as required.
  • Access to Facilities: Outsourced workers have access to the same facilities and amenities as direct employees, promoting inclusivity and well-being.

Responsibilities

  1. University Administration:
    • Oversee the implementation and enforcement of this policy across all departments.
    • Ensure that all outsourcing agreements incorporate the university’s labour standards requirements.
  2. Human Resources Department:
    • Provide training and resources to departments on fair labour practices.
    • Monitor the treatment of outsourced workers and address any issues that arise.

Review and Monitoring

This policy will be reviewed biennially to ensure alignment with updates in national labour laws and international labour standards. The university is committed to continuous improvement in promoting fair and equitable labour practices.
